Hugo Terms of Service

These Terms govern intentional use of the official hosted Hugo Discord bot, public website, and web dashboard. They explain what users and server administrators may do, who is responsible for configured automation, and the limits of the service.

1. Scope and Acceptance

These Terms of Service are an agreement between you and Hugo's owner/operator (the Operator). Hugo or the Service means the official hosted Hugo Discord bot, its public pages, and its web dashboard. A separately self-hosted copy of Hugo's source code is governed by its applicable source-code license and the terms chosen by that copy's operator.

These Terms apply when you intentionally use Hugo, including by inviting or configuring it, signing in to the dashboard, submitting a command or component interaction, or asking Hugo to process content. By continuing that intentional use after these Terms are made available, you agree to them. The Privacy Policy is incorporated into these Terms and explains data processing.

Merely being a member of a server where administrators have enabled Hugo is not treated here as your affirmative acceptance of every optional feature. If you do not agree, do not intentionally interact with Hugo, ask the server's administrators about their configuration, and do not sign in to the dashboard. An authorized administrator may remove Hugo, but removal does not itself erase stored data or cancel a third-party subscription.

You may not use Hugo, its dashboard, or its outputs to:

An applicable source-code license or law may separately permit you to inspect, modify, or test a copy of source code you control. It does not authorize access to, or security testing of, the official hosted Service or another person's systems without permission.

Do not submit passwords, authentication tokens, private keys, payment-card data, medical records, government identifiers, or other secrets or highly sensitive information to Hugo. Hugo is not designed as an emergency service or a secure vault.

4. Submitted Content and Intellectual Property

Submitted Content means text, commands, configuration, templates, embeds, URLs, media, attachments, names, moderation reasons, QOTD pitches, confessions, suggestions, reminders, announcements, autoresponses, automessages, role DMs, and other material that you deliberately provide to Hugo. Processed Content means ordinary Discord messages, attachments, profile details, and other Discord data that a server-configured feature makes available to Hugo without the affected member deliberately submitting it to Hugo.

5. Server Administration and Automated Actions

By enabling a feature, server administrators instruct Hugo to perform the configured actions. Depending on permissions and settings, Hugo can read, filter, delete, repost, or log messages; send direct messages; assign or remove roles; create or edit channels and threads; change Hugo's server-specific nickname; issue warnings; time out, kick, or ban members; restore state; and schedule later actions without a separate human confirmation each time.

Hugo depends on or links to services including Discord, Patreon, Twitch, YouTube, Tenor, The Cat API, GitHub when remote backups are configured, bot-listing services, Discord's CDN, and remote hosts selected through user-supplied URLs. The Privacy Policy explains what data can be sent to them.

9. Privacy and Data

The Privacy Policy explains what Hugo processes, where data can be sent, dashboard sessions and cookies, retention, backups, security limitations, and how to make an applicable access, correction, or deletion request. Using Hugo does not replace any separate notice, permission, or consent required by applicable law.

The Operator may restrict a user, server, feature, dashboard session, trial, or entitlement; refuse a request; or remove Hugo when reasonably necessary to address a Terms violation, abuse, fraud, security threat, legal or Discord requirement, loss of required third-party access, operational risk, or harm to the Service or others. Urgent action may occur without advance notice.

You can stop intentionally interacting with Hugo, log out of the dashboard, ask an authorized administrator to disable a feature or remove Hugo, and separately cancel any third-party subscription. An Operator restriction, suspension, or removal does not itself cancel recurring Patreon billing; use the provider's controls to cancel it. Mandatory refund and consumer rights remain unaffected. If you believe Operator enforcement was mistaken, contact the support server with the relevant user/server ID and context; review does not guarantee restoration.

Ending use does not automatically erase data or Discord-hosted content. Sections that by their nature must continue—including the limited permissions needed for copies retained under Section 4, payment or refund obligations that have already arisen under an applicable offer or provider terms, disclaimers, liability limits, data retention, and general terms—survive termination to the extent permitted by law.

12. Disclaimers

To the maximum extent permitted by applicable law, Hugo is provided "as is" and "as available". The Operator disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

The Operator does not warrant that Hugo will be uninterrupted, secure, accurate, compatible, error-free, or suitable for a particular server; that content or external results are lawful or reliable; that moderation will catch every violation or avoid every false positive; that scheduled actions or backups will complete; or that lost configuration or data can be recovered.

Nothing in these Terms excludes a warranty, remedy, or statutory consumer right that cannot lawfully be excluded.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, content, access, revenue, profits, reputation, opportunities, or expected savings arising from or related to Hugo.

This limitation includes losses arising from server configuration, automated moderation, role or permission changes, user-submitted or third-party content, Discord actions, account compromise outside the Operator's reasonable control, missed or duplicate notifications, failed scheduled actions, service interruption, data loss, or third-party services.

You remain responsible for your own content, instructions, server configuration, legal compliance, and misuse of Hugo. Nothing in these Terms limits or excludes liability where doing so would be unlawful.

14. Changes to These Terms

The Operator may revise these Terms when Hugo's features, risks, providers, business model, or legal obligations change. Unless a revision states a later date, the effective date is the date displayed at the top. Where reasonably practicable, notice of material changes may be provided through the Service or support server; notice will be provided where applicable law requires it.

Changes apply from their effective date. Your continued intentional use after that date means you accept the revised Terms. If you do not agree, stop using Hugo, ask an authorized administrator to remove or disable it as appropriate, and separately cancel any third-party subscription you no longer want.
